Terms of Use
1. Acceptance
By subscribing to or using any Poolmind8 application, including by joining a Maná8 circle as a guest, you declare that you have read, understood and accept these Terms of Use and the Privacy Policy. In the apps, this declaration is made by tapping "I have read and accept": by the license holder, before first use; and by guests, before joining each circle. If you do not agree, please do not use our products.
2. License
Upon subscribing, you receive a personal, non-transferable license to use the application on up to two devices simultaneously, valid for the duration of your subscription. The license is tied to the email address used at the time of purchase. Sharing, reselling, or transferring the license to third parties is prohibited.
3. Subscription and renewal
Access to Poolmind8 applications is provided through an annual subscription. Subscriptions renew automatically at the end of each paid period at the price in effect at the time of renewal, unless cancelled before the renewal date. Current prices for each product line are available on the respective purchase pages. You may cancel your subscription at any time: for Brazilian subscriptions (Cakto), send an email to hello@poolmind8.com; for international subscriptions (Paddle), manage your subscription at paddle.net. Cancellation takes effect at the end of the current paid period — you keep access until then, and no further charges are made.
4. Payment and refund
Brazilian purchases are processed by Cakto. Cakto may charge the buyer its own service fee, shown at checkout before payment and added to the app price. International purchases are processed by Paddle.com (Paddle, 15 Briery Close, Great Oakley, Corby, Northamptonshire, NN18 8JG, United Kingdom), which acts as the Merchant of Record for all international transactions. Paddle handles the transaction, billing, and applicable taxes on behalf of Poolmind8. Refund policy: Brazilian purchases (Cakto) carry a 7-day unconditional money-back guarantee from the date of the first charge. International purchases (Paddle) carry a 14-day unconditional money-back guarantee from the date of the first charge. Refund requests for Brazilian purchases must be sent to hello@poolmind8.com. Refund requests for international purchases must be submitted through Paddle's support at paddle.net. A refund automatically cancels the subscription and immediately revokes access to the application. After the guarantee period, no refunds are issued. You may still cancel your subscription as described in Section 3.
5. Device limit
Each license allows simultaneous use on up to 2 devices. A third device will be blocked automatically. If you change devices, contact us at hello@poolmind8.com and we will reset your device registration. There is no limit on the number of device changes over time.
6. Nature of the product
Poolmind8 applications are digital entertainment tools in the Pocket Instruments category. They do not replace physical instruments, music teachers, or music education of any kind. The sounds and rhythms included are for recreational use only.
7. Use by minors — Kids lines
Some Poolmind8 product lines have a version aimed at children ("Kids"), with adapted visuals and content. The subscription and account management must be carried out by a legal guardian of legal age. Poolmind8 does not intentionally collect personal data from minors — the account is tied to the email address of the person who made the purchase. We recommend that use of the application by children be supervised by an adult. The existence of a Kids-oriented line does not imply any form of content curation, moderation, or supervision by Poolmind8 beyond what is described in these Terms; responsibility for the use of the application by minors rests with the legal guardian who subscribed.
8. Maná8 — circles with guests
In Maná8, the license holder can open a circle and invite other people through a temporary QR code or link. Guest access is free, requires no account, is valid only for that circle and ends when the circle is closed by the license holder, when its time runs out or when the license holder's device stops sending a signal. The license holder is responsible for who they invite and for what happens in their circle. Guests under 18 must take part with the knowledge and supervision of their parents or guardians. Duration and participant limits are those shown in the app and on the product page. Poolmind8 may end circles in case of misuse.
9. Maná8 — circle sound on the host's phone and sync
The "Circle sound on my phone" mode is optional. In it, guests' devices send the license holder's device only control signals (which groove and whether they are playing), and everyone's sound comes out of the license holder's device. Sound quality, delay and sync depend on each participant's devices, speakers, Bluetooth and internet connection, and performance depends on the capacity of the license holder's device. Therefore, Poolmind8 does not guarantee perfect sync or uninterrupted operation of this mode.
10. End-of-circle card, photos and sharing
When closing a circle, the license holder can photograph the participants to create a card. The photo is taken on the license holder's device and sent, encrypted, only to the devices present in the circle; Poolmind8 does not store, moderate or claim any rights over the photos. By taking the photo, the license holder declares that they have the consent of the people who appear in it and, in the case of children and teenagers, of their parents or guardians. Each person who shares the card, whether the license holder or a guest, is solely and entirely responsible for the content they share, where they share it and with whom. Sharing on other platforms, such as WhatsApp and Instagram, follows those platforms' rules, and Poolmind8 is not liable for any use third parties make of shared content. The frame, logos and artwork of the card remain the property of Poolmind8, and their use is permitted only for personal, non-commercial sharing.
11. Intellectual property
All content included in our applications — sounds, images, designs, and code — is the exclusive property of Poolmind8 Desenvolvimento de Software Ltda. or used under license. Unauthorized reproduction, distribution, or modification is prohibited.
12. Limitation of liability
Poolmind8 is not liable for any indirect, incidental, or consequential damages arising from the use or inability to use our applications. Our total liability is limited to the amount paid for the current subscription. This limitation applies to the extent permitted by applicable law and does not affect the rights that consumer protection laws in your country grant you.
13. Service availability
We strive to maintain our services available at all times, but do not guarantee uninterrupted availability. We reserve the right to perform maintenance, updates, or changes to the apps without prior notice.
14. Misuse and suspension
We reserve the right to suspend or terminate access to our applications, without prior notice, in cases of: violation of these Terms of Use, fraudulent or abusive use of the refund policy, unauthorized sharing or distribution of access credentials, use of the circle or the card for unlawful or offensive content or content that violates the rights of others, attempts to reverse-engineer, copy, or extract the content of our applications, or any use that compromises the integrity of our services. In the event of suspension due to misuse, no refund will be issued.
15. Governing law
These Terms are governed by Brazilian law. Any disputes shall be resolved in the courts of the city of São Paulo, State of São Paulo, Brazil. If you are a consumer living outside Brazil, this does not deprive you of the protection of the mandatory consumer protection rules of your country of residence, nor of your right to bring proceedings in the courts of that country where the law allows it.
