Terms of Use
1. Acceptance
By subscribing to or using any Poolmind8 application, you agree to these Terms of Use. If you do not agree, please do not use our products.
2. License
Upon subscribing, you receive a personal, non-transferable license to use the application on up to two devices simultaneously, valid for the duration of your subscription. The license is tied to the email address used at the time of purchase. Sharing, reselling, or transferring the license to third parties is prohibited.
3. Subscription and renewal
Access to Poolmind8 applications is provided through an annual subscription, automatically renewed at the end of each period unless cancelled in advance. Current prices for each product line are available on the respective purchase pages. After cancellation or non-renewal, access remains available for a grace period before the account is deactivated; usage data is preserved during this period.
4. Payment and refund
Brazilian purchases are processed by Cakto. International purchases are processed by Gumroad. Both processors offer an unconditional money-back guarantee within 7 days of the first subscription charge. Refund requests must be submitted directly to the respective processor within this period. Poolmind8 does not process refunds directly — they are handled entirely by Cakto or Gumroad according to their own policies. After the guarantee period, cancellations follow the terms described in Section 3.
5. Device limit
Each license allows simultaneous use on up to 2 devices. A third device will be blocked automatically. If you change devices, contact us at hello@poolmind8.com and we will reset your device registration. There is no limit on the number of device changes over time.
6. Nature of the product
Poolmind8 applications are digital entertainment tools in the Pocket Instruments category. They do not replace physical instruments, music teachers, or music education of any kind. The sounds and rhythms included are for recreational use only.
7. Use by minors — Kids lines
Some Poolmind8 product lines have a version aimed at children ("Kids"), with adapted visuals and content. The subscription and account management must be carried out by a legal guardian of legal age. Poolmind8 does not intentionally collect personal data from minors — the account is tied to the email address of the person who made the purchase. We recommend that use of the application by children be supervised by an adult. The existence of a Kids-oriented line does not imply any form of content curation, moderation, or supervision by Poolmind8 beyond what is described in these Terms; responsibility for the use of the application by minors rests with the legal guardian who subscribed.
8. Intellectual property
All content included in our applications — sounds, images, designs, and code — is the exclusive property of Poolmind8 Desenvolvimento de Softwares Ltda. or used under license. Unauthorized reproduction, distribution, or modification is prohibited.
9. Limitation of liability
Poolmind8 is not liable for any indirect, incidental, or consequential damages arising from the use or inability to use our applications. Our total liability is limited to the amount paid for the current subscription.
10. Service availability
We strive to maintain our services available at all times, but do not guarantee uninterrupted availability. We reserve the right to perform maintenance, updates, or changes to the apps without prior notice.
11. Governing law
These Terms are governed by Brazilian law. Any disputes shall be resolved in the courts of the city of São Paulo, State of São Paulo, Brazil.
